This is provided for by the Act on assistance to Ukrainian citizens: Articles 100c and 100d suspended part of the administrative deadlines, so the voivode may examine a residence-card case longer than usual.

OBTAINING A RESIDENCE CARD BASED ON BUSINESS IN WARSAW
A residence card based on business activity is suitable for foreigners who run a business in Poland, develop a JDG, own a company, or participate in managing a company.
For this type of application, it is not enough to simply fill in the form. You need to show that the business is real: company registration, financial results, taxes, ZUS, income, expenses, contracts, clients, and the economic purpose of the activity.
From 27 April 2026, the standard application for a residence card is submitted through MOS 2.0 in electronic form. Therefore, business documents must be prepared in a way that confirms the basis of stay and is suitable for electronic submission to the office.

JDG AND SP. Z O.O. — WHAT DOES THE OFFICE CHECK?
A residence card based on business is not issued simply because a company has been registered. The office checks whether the activity is actually being carried out: income, clients, contracts, account transactions, taxes, ZUS, and accounting.
Individual business activity
The foreigner conducts the activity personally: provides services, issues invoices, works with clients and receives income from their own business.

Opening a sole proprietorship itself does not guarantee a residence card. Without clients, income, invoices and bank-account movement, the business is considered a weak basis.
Owning shares alone is not enough. The applicant needs a real role and the company needs real activity. An empty company without turnover is a weak basis.
Common criteria for JDG and Sp. z o.o.
These criteria apply to business as a residence-card basis. They may apply to both JDG and Sp. z o.o., but the document set depends on the business form, the applicant’s role and the actual situation.
Business income
The business has already reached the required income for the previous tax year. The office looks at income and the financial result, not only turnover.
Confirmed by: PIT-36/PIT-28 for JDG, CIT-8 for a company, accounting, statements and no-arrears certificates.

The business creates jobs: at least 2 full-time employees on indefinite-term contracts for at least one year before submission.

Future fulfilment of conditions
A new business shows its ability to meet the requirements in the future: funds, contracts, clients, investments, premises and a business plan.

When Załącznik nr 1 is needed
It is needed if the basis is connected with a function in a company: member of the zarząd in Sp. z o.o. or S.A., komplementariusz in sp.k. / S.K.A. or prokurent.
For a standard JDG this is not the central document. Real activity, income, clients, ZUS and tax payments and accounting are more important.
WHAT DOES A RESIDENCE CARD BASED ON BUSINESS IN POLAND GIVE YOU?

DOCUMENTS FOR A RESIDENCE CARD BASED ON BUSINESS THROUGH MOS 2.0
Below is the basic list of documents for applying for a residence card based on business through MOS 2.0. The final package depends on the form of business: JDG, sp. z o.o., participation in the management board, shareholder status, turnover, taxes, ZUS, and the actual activity of the company.
1. Completed electronic application in MOS 2.0.
2. Digital photo for submission through MOS 2.0.
3. Scan or photo of all pages of a valid passport.
4. Confirmation of payment of the stamp duty of 340 zł for processing the application based on business activity.
5. Documents confirming health insurance in Poland.
6. Confirmation of residential address in Poland — if required in the case.
7. Documents confirming stable and regular income.
8. Business documents: CEIDG or KRS, articles of association, resolutions, details of the management board / shareholders — depending on the form of activity.
9. Documents confirming real business activity: contracts with clients, invoices, bank account statements, payment confirmations, reports, documents concerning employees or contractors.
10. Accounting documents: PIT / CIT, VAT, ZUS, księga przychodów i rozchodów, or other confirmations of the company’s financial activity.
11. Electronically signed annex to the application — if the basis is connected with performing a function in the management board, prowadzenie spraw spółki, acting as a komplementariusz, or acting as a prokurent.
12. Translations into Polish if the documents are not in Polish and require translation by a sworn translator.
13. If the application is submitted by a representative — pełnomocnictwo and confirmation of payment of 17 zł for the power of attorney.
14. Electronically certified scans of paper originals — if documents that exist only in paper form need to be submitted later in the case.
After the launch of MOS 2.0, paper supplements to the case are not accepted at the service desk. If the office requests additional documents, they must be submitted electronically. If a document exists only as a paper original, a scan certified electronically as a true copy of the original should be prepared in advance.
INCOME, TURNOVER AND PROFIT — WHAT IS THE DIFFERENCE?
When applying for a residence card based on business in Poland, it is important not to confuse company turnover with real income. The office looks not only at how much money passed through the JDG or sp. z o.o., but also at the financial result of the activity after expenses.
For a residence permit based on business, accounting documents, PIT or CIT, invoices, contracts with clients, bank account transactions, ZUS, taxes, and confirmation that the business is actually operating are important. Therefore, before applying, it is necessary to check not only company registration, but also the financial picture: przychód, dochód, koszty, and the documents confirming them.
BUSINESS PLAN FOR A RESIDENCE CARD BASED ON BUSINESS ACTIVITY
A business plan for a residence card based on business activity is needed when the company’s financial history alone is not yet enough to safely confirm the business basis. This most often applies to a new JDG, a recently opened Sp. z o.o., or a business that is already operating but has not yet shown strong results for a full tax year.
The office does not treat a business plan as an advertising description of the company. The inspector should be able to see that the activity makes sense in Poland: who pays for the services or goods, where the orders come from, what expenses have already appeared, what income is expected, and how the company will be able to meet the requirements for a residence card based on business activity.
A simple example: a person opened a Sp. z o.o. a few months ago. The company does not yet have annual financial statements with high income and does not employ two full-time workers, but it already has its first contracts, money in the account, start-up expenses, agreements with clients, and a clear development plan. In this situation, the business plan helps show that the company was not created only “for the residence card”, but is actually starting operations and may meet the requirements in the future.
For JDG, the logic is built around the entrepreneur personally. The office must understand what the person does, who they provide services to, how they receive payment, and why this activity can be a stable basis for a residence permit. For Sp. z o.o., it is also important to show the applicant’s role in the company: who manages the company, who makes decisions, and how the applicant is connected with the company’s income, clients, and business development.
A strong business plan should contain numbers and specifics. Not only a description of the service, but also a financial forecast: expected income, main expenses, planned payments, investments, possible hiring, and development for the coming months. In Polish practice, this is often called prognoza finansowa — a financial projection showing how the business will develop further.
The business plan must match the documents in the case. If it mentions clients, contracts, investments, office rental, equipment, advertising, or a hiring plan, these elements should be confirmed by attachments. Otherwise, the document looks separate from the real business activity and does not strengthen the application.

BUSINESS-BASED RESIDENCE CARD FOR UKRAINIAN CITIZENS: PESEL UKR, JDG AND CUKR
A Ukrainian citizen with PESEL UKR may conduct business activity in Poland and register a JDG through CEIDG. For Ukrainian citizens, this is the closest Polish equivalent of a sole proprietorship: the person works in their own name, issues invoices, pays ZUS and taxes, keeps accounting records and may use the business as a basis for further legalisation.
For a residence card based on business activity, PESEL UKR or the mere registration of a JDG is not sufficient. The office checks the activity itself: whether the company operates, has clients, income, accounting documents and proof that the entrepreneur actually conducts business in Poland.
A CUKR residence card is a separate route for Ukrainian citizens with UKR status. After obtaining CUKR, the person receives a temporary residence permit for 3 years, full access to the labour market and the right to conduct business activity in Poland under the same rules as Polish citizens. A CUKR holder may therefore open a JDG, but for a future business-based residence-card application, actual company activity remains important in addition to registration.

For a standard JDG, other documents are central: real activity, income, clients, accounting, ZUS, taxes and movement on the business account.
The official fee for a temporary residence application based on business is 340 zł. After a positive decision, the plastic residence card is paid separately — 100 zł.
If a representative acts in the case, the power of attorney fee is also paid — 17 zł.
A refusal may be connected with the company looking formal only: unclear activity, weak financial documents, unclear applicant’s role, debts, inconsistencies in documents or insufficient proof of income.
The risk is higher when the business exists only on paper and the documents do not show clients, inflows, expenses, development and a real connection between the applicant and the company’s activity.
