Statutory processing deadlines for residence permit cases are suspended until 4 March 2027

This follows from the Act on Assistance to Citizens of Ukraine: Articles 100c and 100d suspend certain administrative deadlines, which means that a voivode may take longer than usual to process a residence permit case.

It is still possible to take steps to move a case forward. We first submit a ponaglenie to the higher authority and, if there is no response, challenge inactivity or excessive delay before the Voivodeship Administrative Court (WSA). This often prompts the authority to begin actively processing the case, and the court may award compensation for unlawful delay. We can prepare the complaint and manage the acceleration procedure.

PERMANENT RESIDENCE BASED ON THE KARTA POLAKA

Permanent residence based on the Karta Polaka is a permanent status in Poland for a person who already holds a valid Karta Polaka and intends to make Poland their long-term home.

The key document in this procedure is the Karta Polaka itself. It confirms that the applicant's connection with Poland has already been established. However, the permanent residence application must still be prepared correctly and supported with a passport, photograph, proof of address, financial and insurance documents, personal-status records and evidence of the intention to reside permanently in Poland.

Following a positive decision, the applicant receives an indefinite right of residence in Poland. The permit itself does not expire, while the physical residence card must be replaced every 10 years.

WHAT PERMANENT RESIDENCE PROVIDES

Permanent residence gives you a stable status in Poland without the need to renew a temporary residence permit regularly.

The main benefits include:

an indefinite right to reside in Poland;
no dependence on a specific employer, course of study or business activity as the basis of residence;
full access to the Polish labour market without a separate work permit;
the right to run a business in Poland;
travel within the Schengen Area for up to 90 days in any 180-day period;

The Karta Polaka and Permanent Residence Are Not the Same

The Karta Polaka confirms a connection with the Polish nation, but it is not a residence permit. It does not, by itself, authorise indefinite residence in Poland. A separate permanent residence permit is required.

Where an applicant already holds a Karta Polaka, the authority generally does not re-examine Polish origin as extensively as in a case based solely on ancestry. The documents must nevertheless be current and consistent: passport, Karta Polaka, personal details, address, income, health insurance, electronic application and any other evidence relevant to the case.

DOCUMENTS FOR PERMANENT RESIDENCE BASED ON THE KARTA POLAKA IN WARSAW

For an application in Warsaw, the essential elements are a valid Karta Polaka, consistent personal details and a complete electronic document package prepared for MOS 2.0.

The usual documents include:

An electronic application for pobyt stały submitted through MOS 2.0.
A valid passport and digital copies of the relevant passport pages.
A current biometric photograph in digital format.
A valid Karta Polaka.

Since the launch of MOS 2.0, paper supplements cannot be filed at the service desk. Documents requested by the authority must be submitted electronically. Where a document exists only as a paper original, a scan electronically certified as a true copy must be prepared in advance.

WHO QUALIFIES FOR PERMANENT RESIDENCE BASED ON THE KARTA POLAKA

You are legally present in Poland or are planning to establish permanent residence here.
You can document your identity, address and intention to reside permanently in Poland.

This route is intended for a person who holds a valid Karta Polaka and wants to move to a permanent residence status in Poland. The applicant must be legally present in Poland, prepare an electronic application and demonstrate a genuine intention to make Poland their permanent home.

How Long Does Permanent Residence Based on the Karta Polaka Take?

By law, the voivode should issue a decision in a permanent residence case within 6 months. Importantly, this period does not begin on the date the application is sent. It starts only after the last of the following three conditions has been met:
1. the application is free of formal defects;
2. the applicant has appeared in person at the office and provided fingerprints;
3. all documents requested by the authority have been submitted.

Every error in the application or missing document postpones the start of the statutory period, extending the case before the substantive examination has even begun.
In practice, the timeframe depends on the voivodeship, the completeness of the application, the authority's workload, background checks and the speed of replies to official requests. In addition, until 4 March 2027, administrative deadlines in legalisation cases are suspended, so a delay during this period cannot be challenged solely by relying on the expiry of those deadlines.
In Warsaw, the priority is to submit a complete electronic package through MOS without waiting for the first official request. We therefore check personal details, the Karta Polaka, address, income, insurance, translations and family documents in advance to reduce the risk of the case being held up by supplementary submissions.

Holding a Karta Polaka significantly simplifies the substantive assessment. The Karta Polaka is not itself a residence permit, but it gives access to several statutory privileges, including the right to apply for permanent residence. In a permanent residence case based on the Karta Polaka, the authority does not normally require the applicant to prove Polish origin again. Its attention is focused on formal compliance, lawful stay and the consistency of the documents. How the Permanent Residence Procedure Works

The process begins with preparing the documents and submitting the application to the voivodeship office competent for the applicant's place of residence. Although the legal basis is preferential, the formal requirements remain strict. Errors, inconsistencies or gaps in the documents can cause significant delay.

In some cases, the applicant may be invited to a short interview, although this is uncommon in Warsaw. It is usually formal and intended to confirm that the information remains current rather than to retest language skills or origin. It is still advisable to prepare for this stage.

What Happens After Submission Through MOS 2.0

After the application is sent, the case is registered and the applicant is invited to complete the required in-person formalities. The office checks the passport and identity, confirms the signature, takes fingerprints and reviews the document package.

What Permanent Residence Based on the Karta Polaka Provides

A permanent residence permit provides full access to the labour market, removes dependence on a particular employer or temporary legal basis and creates long-term legal stability. The permit does not require renewal and is not affected by a change of employment or personal circumstances.

It also simplifies later procedures, including an application for Polish citizenship. For many Karta Polaka holders, it is the natural next step in the legalisation process.

Can I Apply Without Employment?

Karta Polaka is the principal legal basis for the application, but the authority may still examine how the applicant intends to support themselves and live in Poland. The case should therefore include evidence of an address, financial means, insurance and genuine links with Poland.

Where the applicant is not employed, other evidence should be considered, such as business activity, studies, savings, family support, a tenancy agreement, a spouse's documents or another source of maintenance. A bare application consisting only of the Karta Polaka and passport should not be submitted.

Common Errors and Risks

Most problems in Karta Polaka cases concern the supporting documents rather than the legal basis itself. Common issues include inconsistent surnames, an expired or replaced passport, incomplete address details, insufficient proof of income, inadequate insurance or a missed deadline for replying to an official request.

Financial assistance is a separate issue. It requires a separate application and, if you wish to claim it, the application must be submitted within 3 months of the permanent residence application.

Financial Assistance for Karta Polaka Holders

One of the additional benefits available to Karta Polaka holders is financial assistance from the Polish state. The support is intended to ease the first months after moving to Poland and may contribute towards living costs, rent and everyday expenses. In practice, the application requires correctly completed forms, compliance with strict deadlines and supporting evidence. Financial Assistance Amounts in 2026

The amount is linked to the Polish minimum wage applicable in the year in which the financial-assistance application is submitted. The 2026 minimum wage is PLN 4,806, so the figures below apply to applications filed in 2026. Assistance may be granted for up to 9 months and is divided into two periods: the rate is higher for the first 3 months, while from months 4 to 9 it is 60% of the initial rate. Payments are calculated separately for the applicant, spouse and each minor child and are made monthly by the district authority, either in cash or to a bank account. The benefit may be received only once: a person previously included as a family member cannot later receive it again as an applicant. Important for 2026: since 15 January, consideration of new benefit applications has been temporarily suspended until budget funds are allocated. The application must nevertheless be filed within 3 months of the permanent residence application; otherwise it will be left unexamined. Payment queues progress as funding becomes available.

Polish Citizenship After Permanent Residence Based on the Karta Polaka

Permanent residence based on the Karta Polaka provides the shortest standard route to Polish citizenship: recognition as a Polish citizen by the voivode is available after one year of continuous qualifying residence. By comparison, the standard route requires 3 years, as well as stable income and a legal title to housing.

A common mistake at this stage is to wait until the full year has passed before submitting the application. The voivode assesses whether the conditions are met on the date the citizenship decision is issued, not on the filing date. The one-year period therefore needs to be completed by the date on which the decision on recognition as a Polish citizen is signed. An application may be submitted earlier, allowing the remaining months to accrue while the case is being examined. The one-year period runs from the date on which the permanent residence decision became final; the date on which the physical card was collected is irrelevant.

Continuity of residence is assessed under the rule that art. 195 ust. 4 ustawy o cudzoziemcachno single absence may exceed 6 consecutive months and total absences may not exceed 10 months. Polish-language knowledge may be confirmed by a certificate issued by the State Commission at level B1 or above, a certificate of graduation from a school in Poland, or a certificate from a foreign school in which Polish was the language of instruction. Since 1 July 2025, a post-secondary school (szkoła policealna) certificate no longer confirms Polish-language knowledge for this purpose. Stamp duty for the decision on recognition as a Polish citizen: PLN 1,000.
