Electronic Certification of Documents
From 27 April 2026, paper documents cannot be submitted in cases initiated through the new MOS 2.0 system. Paper originals must first be electronically certified as true copies by a notary, legal counsel (radca prawny) or attorney-at-law.

Statutory processing deadlines for residence permit cases are suspended until 4 March 2027

This follows from the Act on Assistance to Citizens of Ukraine: Articles 100c and 100d suspend certain administrative deadlines, which means that a voivode may take longer than usual to process a residence permit case.

It is still possible to take steps to move a case forward. We first submit a ponaglenie to the higher authority and, if there is no response, challenge inactivity or excessive delay before the Voivodeship Administrative Court (WSA). This often prompts the authority to begin actively processing the case, and the court may award compensation for unlawful delay. We can prepare the complaint and manage the acceleration procedure.

What is a Blue Card in Poland?

The Blue Card, or EU Blue Card (Niebieska Karta UE), is a temporary residence permit for a non-EU national who works in Poland in a profession requiring high qualifications.

A specific job requiring high qualifications forms the basis of the case. The authority assesses the position and duties, the contract, the employment period, gross salary, the education or professional experience of the applicant, health insurance and documents from the employer.

The Blue Card is not limited to IT specialists. It may also be obtained for another profession where the work requires specialist knowledge and skills and the applicant proves the qualifications with a diploma or relevant experience.

Who can obtain a Blue Card in Poland

A Blue Card may be obtained by non-EU nationals who are staying in Poland on a basis that allows them to submit an application and who plan to work here in a profession requiring high qualifications. A positive decision requires the conditions concerning the contract, salary, qualifications and employer documents to be met simultaneously.

Non-EU national

On the date of submission, the applicant is staying legally in Poland and the basis of stay permits the Blue Card procedure to be initiated.

Highly qualified employment

The position requires specialist knowledge, skills and competences acquired through education or professional work.

Contract for at least six months

An employment contract, a home-based work contract (umowa o pracę nakładczą) or a civil-law contract under which the work is performed may be used.

The remuneration meets the threshold

The gross amount stated in the contract meets the Blue Card threshold applicable in the year of submission.

Diploma or professional experience

Qualifications are proved by completing a higher-education programme lasting at least three years or by documents confirming professional experience.

BLUE CARD DOCUMENTS THROUGH MOS 2.0

The basic list of documents for a Blue Card depends on the position, contract, employer and qualifications of the applicant. After the launch of MOS 2.0, the application and attachments are prepared for electronic submission.

Documents normally required:

  1. Electronic application through MOS 2.0.
  2. Scans or photographs of all pages of a valid passport.
  3. A digital photograph for submission through MOS 2.0.
  4. Confirmation of payment of the PLN 440 stamp duty (opłata skarbowa).
  5. An employment contract concluded for at least six months.
  6. Annex completed by the employer for the Blue Card application.
  7. Employer documents: KRS/CEIDG, NIP and REGON—where required for the case.
  8. Documents proving qualifications: a diploma, diploma supplement or documents confirming professional experience.
  9. Sworn translations of documents issued in a language other than Polish.
  10. Proof of health insurance.
  11. Confirmation of the address of residence in Poland—where required for the case.
  12. Documents confirming the salary, position, working time and employment period.
  13. Access to a Profil Zaufany, qualified electronic signature or personal signature (podpis osobisty).
  14. Electronically certified copies of paper originals—where a document that exists only in paper form must be attached to the case.

Since the launch of MOS 2.0, paper supplements to an electronic case are not accepted at the customer-service desk. If the authority requests additional documents, they must be prepared and submitted electronically.

Blue Card eligibility requirements

All Blue Card requirements must be met at the same time. A high salary does not replace the required qualifications, and a diploma does not correct a contract that does not match the position or was concluded for too short a period.

Nature of the work

The position and actual duties must require high professional qualifications, rather than merely general work experience.

Written contract

Employment, the provision of services or an official service relationship must be evidenced by a contract, concluded for at least six months.

Professional qualifications

The required level of knowledge is demonstrated by completed higher education or documented professional experience.

Remuneration

The annual gross amount stated in the contract must meet the threshold applicable in the year in which the application is submitted.

Health insurance

Polish health insurance, entitlement to be covered by it after employment begins, or an insurance policy covering treatment in Poland.

Regulated profession

If the profession is regulated under Polish law, the right to practise the profession must also be proved.

Requirements for obtaining an EU Blue Card

To obtain an EU Blue Card in Poland, a number of requirements must be met:
- Concluded employment contract with a Polish employer;
- The work is related to a profession requiring high qualifications;
- Documents confirming higher education or relevant professional experience (at least five years);
- The remuneration must be at least 150% of average gross remuneration in the country (for 2025, this was from PLN 9,878 gross per month);
- Possession of health insurance;
- Registration of the address of residence in Poland.

Blue Card salary threshold in 2026

For applications submitted in 2026, the average remuneration in the national economy for 2025 is used.

The assessment is based on the remuneration expressly stated in the contract. Bonuses and variable payments cannot automatically be counted as part of the guaranteed threshold.

Can a Blue Card be obtained without a diploma

Yes. High professional qualifications may be proved not only by a diploma, but also by professional experience.

Under the standard route, at least five years of professional experience at a level comparable to qualifications obtained after higher education is required. Employment, self-employment and the provision of professional services may be taken into account.

For professions on the special list, three years of experience gained within the seven years preceding the application is sufficient.

A CV alone does not prove qualifications. Documents are needed to establish the period of employment and the scope of duties performed: employer certificates, contracts, employment certificates, business records, references describing the responsibilities of the applicant and other evidence of practical experience.

The title of a previous position should not be the only evidence. The authority must be able to see a connection between the previous professional activity of the applicant and the job for which the Blue Card is being sought in Poland.

What the employer must do for a Blue Card application

When completing the application, the foreign national provides the email address of the employer. MOS sends a link to a separate electronic form to that address Załącznik nr 1.

The employer opens the link, enters the company details and the conditions of the assigned work, and then signs the annex through login.gov.pl. It may be signed by a person authorised to represent the company, using a Profil Zaufany, a personal signature (podpis osobisty) or a qualified electronic signature.

Once submitted, the annex is automatically attached to the application of the foreign national. Only then can the applicant sign and submit their own application.

Information in Załącznik nr 1 must be consistent with the contract and remain current on the date of the decision. Before signing, check the names of the parties, the position, working time, contract term, place of work and remuneration.

The employer helps prepare the documentation but does not become a party to the proceedings. The foreign national remains the party to the case before the voivode.

Blue Card or a standard work-based residence permit

A standard work-based residence permit is available for a wider range of professions. A Blue Card is more difficult to obtain, but once issued it provides additional mechanisms that are not available under the standard permit.

No independent entitlement to register a JDG

Standard temporary residence and work permit on its own does not give the right to register a sole proprietorship (JDG).

Legalisation of residence for the family of a Blue Card holder

The spouse and minor children of a Blue Card holder may obtain temporary residence permits for family reunification. A separate application is submitted for each family member—the Blue Card of the main applicant does not automatically cover the family.

A spouse may submit an application while the case of the main applicant is still pending, without waiting for the Blue Card decision. Where the applications are filed at almost the same time, Polish law provides for the case of the family member to be examined after the decision on the application of the Blue Card holder.

Since 1 June 2025, the family of a Blue Card holder no longer has to prove stable income or secured accommodation. Health insurance remains mandatory.

After receiving a residence permit for family reunification, the spouse gains access to the Polish labour market without a separate work permit.

Can a sole proprietorship (JDG) be opened with a Blue Card

Yes. Since 1 June 2025, a Blue Card holder may register a sole proprietorship in CEIDG and operate it on the same terms as a Polish citizen.

A sole proprietorship (JDG) may be combined with the highly qualified employment on which the Blue Card was issued. For example, a specialist may continue working under a contract while also providing their own services or developing a separate business.

Registering a sole proprietorship (JDG) does not convert a Blue Card into a residence permit based on business activity. Its legal basis remains highly qualified employment. If the person stops such employment completely, the rules on loss of employment begin to apply: the voivode must be notified, and a new employer must be found within the applicable period or the person must switch to another basis of stay.

Therefore, before giving up employment in favour of running only a business, it is necessary to assess not the registration of the company itself, but the future legal basis of stay in Poland.

Assistance with obtaining a Blue Card in Warsaw

We begin by assessing the situation. We determine whether the current status of the foreign national allows an application to be submitted in Poland and whether professional qualifications should be proved through education or experience.

We then prepare the list of documents specifically for the selected position. We separately identify which materials are prepared by the applicant, which are provided by the employer and which foreign documents require a sworn translation.

We provide the employer with instructions in the electronic Załącznik nr 1. Once it has been completed, we compare the annex with the contract and the application data so that the position, employment period, working time and contracting parties are consistent throughout the file.

For the applicant, we prepare the electronic MOS form, attachments and evidence of qualifications. After verification, the applicant signs and submits the application independently through login.gov.pl and receives the UPO confirmation.

While the case is pending we monitor correspondence, prepare responses to official requests and arrange the electronic submission of additional documents. After the decision is issued, we check the permit period and the further obligations of the Blue Card holder.

If circumstances change while the case is pending —the contract, employer, position or basis of stay—we assess the effect of the change before new documents are sent to the authority.

Changing employer under a Blue Card

Under decisions issued according to the new rules, the holder Blue Card may move to another employer without changing the existing permit and without applying for a new card.

The new employer may be any employer, but the work itself must continue to require high qualifications and the remuneration may not fall below the applicable Blue Card threshold.

A change of employer must be reported in writing to the voivode who issued the permit within 15 working days. The notification is not a request for consent—it simply informs the authority of the change.

Blue Card permits issued on the basis of decisions made before 1 June 2025 remain subject to the transitional rules. Before terminating employment, check the date of the decision and the conditions stated in it, because the earlier permit may have been tied to a specific employer.

Loss of employment under a Blue Card: what to do

A Blue Card is not withdrawn on the day employment ends. The time allowed to find a new employer depends on how much time has passed since the permit was issued.

If fewer than two years have passed since the permit was issued

During this period, the holder may look for a new employer, that meets the Blue Card requirements.

6 months

If employment is lost after two years

After two years of residence under a Blue Card, the holder is granted a longer period to find new employment.

Deadline for written notification

The voivode must be notified when employment ends within 15 working days.

Blue Card mobility within the EU

A Blue Card does not allow the holder simply to move to another EU Member State and begin permanent employment there without completing formalities. It provides two specific mobility mechanisms.

Short-term mobility allows the holder to stay in another EU Member State for up to 90 days in each 180-day period for professional activities connected with employment by an employer in Poland. These may include business meetings, negotiations, conferences, training, marketing activities or market research.

After 12 months of legal stay under a Blue Card, the holder and their family may move to another EU Member State under long-term mobility. An application for a local Blue Card must be submitted in the receiving country under its rules.

The Polish voivode must be notified in writing of the start of long-term mobility within 15 days and indicate the country to which the card holder is moving. The Blue Card mobility scheme does not apply in Denmark and Ireland.

For how long is a Blue Card issued

The validity period of a Blue Card is calculated on the basis of the employment period stated in the documents.

The permit is issued for three months longer than the employment period, issued by the voivode during the examination of the case.

Even with an indefinite or longer-term contract, a single Blue Card is issued for no more than three years.

A Blue Card is not renewed automatically. Before the current permit expires, a new application must be submitted on an appropriate basis of stay.

Who can obtain a Blue Card in Poland?

The Blue Card is intended for non-EU nationals who are legally staying in Poland, will perform work requiring high qualifications, have an appropriate contract, proven qualifications and remuneration no lower than the applicable threshold.

For applications submitted in 2026, annual gross remuneration must be at least PLN 160,264.08. This means a monthly gross amount above PLN 13,355.34.

What type of contract is eligible for a Blue Card?

An eligible contract is a written employment contract, a home-based work contract (umowa o pracę nakładczą) or a civil-law contract concluded for at least six months and covering work in a profession requiring high qualifications.

Can a Blue Card be obtained without a diploma?

Yes. Qualifications may be demonstrated through professional experience comparable to higher education. As a rule, at least five years of experience is required, while selected professions on the official list require three years of experience gained within the previous seven years.

Who completes and signs Załącznik nr 1?

Before the application is submitted, the employer completes the electronic Załącznik nr 1 in MOS and signs it through login.gov.pl. The information in the annex must match the contract and remain current on the date of the decision.

Is proof of an address of residence required for a Blue Card?

No. A legal title to accommodation and proof of secured accommodation are not independent conditions for obtaining a Blue Card.

For how long is a Blue Card issued?

The permit is issued for three months longer than the employment period stated in the documents, but for no more than three years. It is not extended automatically.

Can an employer be changed without obtaining a new Blue Card?

For decisions issued under the new rules, the employer may be changed without obtaining a new card, provided that the new job still requires high qualifications and the salary threshold is maintained. The voivode must be notified in writing within 15 working days.

What should be done after losing employment?

The voivode must be notified in writing within 15 working days. The holder has up to three months to find new highly qualified employment, or up to six months after two years of residence under a Blue Card.

Can family members submit their applications at the same time?

Yes. A spouse and minor children submit separate family-reunification applications; the documents may be prepared and submitted in parallel with the case of the main applicant.

Can the spouse of a Blue Card holder work without a work permit?

After obtaining a temporary residence permit for family reunification, an adult family member may work in Poland without a separate work permit.

Can a sole proprietorship (JDG) be opened with a Blue Card?

Yes. A Blue Card is one of the legal bases that permits registration of a sole proprietorship in CEIDG. However, highly qualified employment remains the primary purpose of stay under the Blue Card.

Can a person work in another EU Member State on a Polish Blue Card?

Under short-term mobility, professional activities may be carried out for a Polish employer for up to 90 days in each 180-day period. Long-term mobility is possible after 12 months of legal stay, but the local Blue Card procedure must be completed in the new country.
