We help you appeal refusals to grant temporary residence permits, permanent residence permits and EU long-term resident permits. You can contact us after submitting your application independently or transfer your case from another representative. We work in Warsaw and accept documents remotely.
You can order appeal preparation alone or entrust us with the entire administrative appeal case. In the first option, you receive a completed document to submit yourself. In the second, we represent you until the appeal decision.
Appeal against the voivode’s refusal
We prepare an administrative appeal against a residence permit refusal with grounds specific to your case. We explain which findings of the voivode you disagree with and what evidence supports your position. If a missing document caused the refusal, we establish whether it was included in the case file and prepare the necessary supplements.
The appeal is addressed to the Head of the Office for Foreigners — Szef Urzędu do Spraw Cudzoziemców. It must be submitted through the voivode who issued the refusal. The deadline is 14 days from proper service of the decision; the day of service is not counted. The date on the decision and the date it is served are not the same. Legal basis: Article 57 § 1 and Article 129 §§ 1–2 of the Code of Administrative Procedure (KPA).
If the authority issued an order refusing to initiate proceedings rather than a decision refusing the permit, a different procedure applies: zażalenie within 7 days after service of the order. Legal basis: Article 61a § 2 and Article 141 § 2 KPA. Appeal rules ↗
Management of the appeal case
With full case management, we submit the appeal under a power of attorney and continue working after it is forwarded to the Office for Foreigners. We prepare responses to the authority’s requests and submit further evidence. We explain each decision you receive and the next steps.
Additional evidence may be submitted during the appeal proceedings. If the case file needs to be supplemented, the Office for Foreigners may conduct supplementary proceedings itself or instruct the voivode to do so. This is provided for in Article 136 § 1 KPA.
Following an appeal, the Office for Foreigners may uphold the refusal, overturn it and decide the merits of the case, or remit the case to the voivode where the statutory grounds are met. Remittal for reconsideration does not mean that a residence permit has already been granted. Legal basis: Article 138 KPA. Powers of the appeal authority ↗
Residence during the appeal
A timely, admissible appeal continues the case at second instance. Residence remains lawful until the final administrative decision if the conditions of the relevant procedure are met: the original application was submitted during lawful residence and had no formal deficiencies, or those deficiencies were remedied within the prescribed period. This rule does not apply where proceedings are suspended at the applicant’s request. Act on Foreigners ↗
Service of the final refusal from the Office for Foreigners changes the situation. A complaint to the administrative court does not extend lawful residence. If there is no other basis for lawful residence and Article 299(6) of the Act on Foreigners applies, there is a 30-day period to leave Poland. Following a refusal at second instance, this period runs from service of that decision. Separate statutory rules apply where return proceedings have already been initiated or a return decision has already been issued.
A new application submitted while an obligation to leave is in force does not automatically extend residence: the law provides grounds for refusing to initiate such proceedings. Judicial review is a separate stage.
Help with your residence permit
Are you still waiting for a decision and would like us to take over your case? We help with residence permit applications on different grounds. We will explain which documents your situation requires and take over further dealings with the office.
If you have already received a refusal, send an enquiry and provide the complete decision. We will explain the grounds on which it may be challenged.
Frequently asked questions
An administrative appeal — odwołanie — is addressed to the Head of the Office for Foreigners but submitted through the voivode who issued the refusal. With full case management, we submit it on your behalf under a power of attorney. If you order appeal preparation only, you receive a completed text and submission instructions.
The period begins on the day after proper service of the decision. For example, if the decision is served on 3 August 2026, the first day is 4 August and the last is 17 August. If the last day falls on a Saturday or statutory holiday, the deadline moves to the next day that is neither a Saturday nor such a holiday.
If a representative acts in the case, the decision is generally served on them. An INPOL or Telegram notification does not replace service of the decision. Article 40 § 2, Article 57 §§ 1 and 4, Article 129 § 2 KPA ↗
It is necessary to establish whether the decision was properly served. We will request a copy of the decision and evidence of service. Service on a representative, electronic delivery and the rules for postal notices also matter.
If the decision was not properly served, the appeal period has not started. However, not having the letter in your possession does not, on its own, prove this. Articles 39–46 and Article 129 KPA ↗
Yes, if you missed it through no fault of your own. The application must be submitted within 7 days after the reason for missing the deadline ceases to exist. At the same time, you must submit the appeal and substantiate the absence of fault.
The application itself does not reinstate the deadline: the authority must issue an order granting it. This seven-day period cannot be reinstated. Pending examination of the application, you may separately request a stay of execution of the decision. Art. 58–60 KPA ↗
If no appeal is submitted, a first-instance decision becomes final once the appeal period expires. It may become final earlier if the right to appeal is waived. A timely, admissible appeal means the case continues at second instance.
The Office for Foreigners’ appeal decision is final in the administrative procedure. The possibility of seeking judicial review does not make it non-final. Service of that decision is relevant to the period for leaving Poland after the refusal. Articles 16 and 127a KPA ↗; Article 299(6) of the Act on Foreigners ↗.
A complaint to the Voivodeship Administrative Court in Warsaw — WSA must be submitted through the Head of the Office for Foreigners within 30 days from service of the decision. You may also apply for a stay of execution; that application is considered separately.
A court complaint does not, by itself, extend lawful residence. A stay of execution is not a new residence permit either. Court proceedings are not included in the administrative appeal fee. Articles 53–54 and 61 of the Law on Proceedings before Administrative Courts ↗
